For one thing it's not even a clear shot of his face. It says Phelps hasn't disputed that it's him but I don't think he's admitted it either, and I don't think he would if he got charged. Another thing, you can't see the bowl or the weed (assuming there was some) or any smoke in the picture that I saw. So at the worst it's a paraphernalia charge.
On that note, how backwards is it to have the paraphernalia fine be 2.5 times what the drug penalty is? For shame, south carolina
