Just because the DA does not have the resources to prosecute certain offenses does not mean the the police will stop investigating and making arrests for these offenses. And if you're ONLY arrested you still will spend time in jail and you still might have to post bail, even if the DA chooses not to pursue the case.

Lets face it, even if your case is never prosecuted, you will still have an arrest record that can haunt you for the rest of your life.
