soo i dislocated my shoulder at work
i took a bad fall on a wet floor that did not hace a caution sign at work today. i went to catch myself by putting my arm on a table and poped it out of place. just got home from the E.R and i gotta wearthis "shoulder imobilizer" for abt 4 to 6 weeks and go for therapy. im worried that my jobs gonna drug test me and that they will use me smoking weed as an excuse to not pay for my medicle bills and fire me. sorry in advance for all the spelling mistskes. im typing with one hand on a lot of perks.

There is something called 'proximate cause' in most states. It may allow the employer to deny or reduce workers compensation benefits if alcohol or drug use is determined to be the proximate cause of your injury.
So, were you under the influence of any drugs or alcohol? A lawyer might argue that it's reasonable to believe that anyone walking in the same spot would have fallen anyway. You might still lose your job, but not incur any medical bills. I would suspect that there is some negligence on the employer because there wasn't a 'Wet Floor' sign in the area, but I'm not sure. You should a few attorneys who specializes in work related issues, in the morning and explain to them what happened. Tell them what you are worried about. Consultations are free. They'll let you know what's up. |

no i wasnt high at all at work i didnt go in till 6 and i smoked a bowl around 1 of some regs and i havnt had a drink since 4th of july lol. im gonna call the boss in the morning. hes mostly a cool guy but i have a feeling hes gonna fight me on this. i dont wanna have to take this to court but if they try to refuse workers comp im gonna have no choice.

workers comp is who you need to worry about. your employer has nothing to do with them. you have a legit claim for workers comp and a lawsuit as well.
your boss will have to be on 'their side', as helping you could cost him his job. it's all about money. don't sign anything. go get a piss cleaner and use it right away . |
