In 1998, Rep. Mark Souder, R-Ind., an advocate of stringent drug laws, slipped into a House bill an amendment denying federal financial aid for college to anyone who had been convicted of either selling or possessing drugs. No congressional committee voted on the amendment. But it passed as part of the reauthorization of the Higher Education Act, first enacted in 1965 to create federal financial aid for college students.

In 2004, the group Students for Sensible Drug Policy asked the federal government to give it a state-by-state breakdown of the number of students denied aid as a result of Souder's amendment. The Department of Education demanded $4,124.19 for the information. SSDP asked for a fee waiver, arguing that releasing the information was in the public's interest and that the group is a cash-strapped nonprofit. The agency denied SSDP's request, arguing that releasing the data could lead to drug legalization. Public Citizen backed SSDP in court. The New York Times editorialized on its behalf. The federal government blinked. On Wednesday, the Department of Education gave SSDP the state-by-state numbers. Here they are.

If this law betters the lives of young people—Souder calls it a way to reduce youth drug use by reducing demand—then no state has done better than Souder's own Indiana. As of August 2005, nearly 9,000 Indianan students—one in 200—have been denied aid since the law passed. That's the highest proportion of students affected in any state by a wide margin.

A week ago, when the Department of Education released preliminary data, I started calling Martin Green, Souder's spokesman, for a comment on Indiana's stellar showing. He has not returned my calls.

There's another funny thing about the Department of Education's numbers: They don't show the number of college applicants punished for drug convictions. They show the number punished for owning up to drug convictions. On their financial-aid applications, students are asked to check a box if they've been convicted of selling or possessing drugs. But the department has no way to verify students' answers. Officials can cross-check the answers with federal arrest records, but they make up a very small percentage of all drug convictions.

So far, about 190,000 students across the country (and abroad) have told the truth and been denied financial aid. It's impossible to know how many lied and headed off to college, federal aid in hand. Nearly 300,000 student-aid applicants, however, simply ignored the question in 2000-2001, the first school year in which it was asked. After internal debate, the Clinton administration decided to give all these students a pass. (A fitting verdict, perhaps, given Clinton's own equivocal response to questions about drug use.)

The Bush administration reversed this "ask, but don't tell" policy. Beginning in 2001, applicants who have refused to say whether they've been convicted of a drug crime are presumed guilty and bounced from the aid pool. That year, the number of students denied aid quintupled.

When Souder's amendment came up for reconsideration last year, its opponents couldn't muster the votes to get rid of it. They settled for a change that denies federal aid only to students caught getting high while in college. That bill was signed by President Bush as part of the Deficit Reduction Act of 2005. But its future is hazy; it's tied up in court because the House and Senate versions differed slightly. Whatever its fate, the government still won't be able to verify much about a student's drug record. Which means they'll catch fibbing students only if they've had the unusual misfortune of being convicted of a federal crime. A word to the wise, and the not-so-wise: You may want to just check "no."

Hinchey's pro-medpot amendment was defeated 264-161 on June 15 in the House of Representatives. The House has defeated the amendment twice before but there were 13 more votes for the measure this year compared with the totals last year. Only 15 Republicans out of 231 in the House supported the measure.

Drug warrior Republican Representative Mark Souder, who works hard on behalf of prohibition, said Hinchey and his supporters are "hiding behind a few sick people to try to in effect legalize marijuana in this country. The rhetoric about marijuana as a treatment for medical purposes was probably dreamed up at some college dorm."

Democrat Hinchey countered that his failed amendment had nothing to do with recreational marijuana.

Aside from his $133,600 congressional salary, all the money Rep. Mark Souder, R-4th, earned last year came from the Grabill businesses his family owns. His debts are associated with the businesses, according to a yearly financial disclosure form he filed with the clerk of the House.

Souder reported he made two trips last year -- one overseas and one to Florida -- that he did not pay for. The U.S.-Thailand Business Council paid the bill for a 16-day trip to Thailand last fall, and the Council for National Policy paid for Souder's flight and overnight expenses to make a speech in Orlando in March 1996.

House officials will release the reports next month, but Souder made his statement available early. The reports show - in very broad ranges - the sources and amounts of income, assets and debts.

Souder reported he has a 50.5 percent partnership interst in Souder's General Store, which is worth $15,001 to $50,000.

Souder also reported he owes 25 percent of a $10,001 to $15,000 mortgage on Historic Souder's. Lawmakers are not required to report mortgages on their residences.

Not only had they elected new student leaders, but nearly two-thirds of the undergraduates who voted endorsed a referendum to reduce penalties for students caught with marijuana so that they would be treated the same as alcohol violations -- a result with much symbolic weight but no actual power to change the school's policies.

Drug Offenses Cost Indiana Students College Aid

Indiana leads the nation in the rate of college students being denied federal aid because of a law that bars those with drug convictions from receiving tuition assistance, a study published Monday showed.

Since 2000, more than 8,900 Indiana students have lost their eligibility for federal financial aid because of drug offenses, according to an analysis by the advocacy group Students for Sensible Drug Policy.

That amounts to one out of every two hundred Indiana students who applied for aid.

Nationwide, about 190,000 students lost their financial aid eligibility, the federal data show.

Indiana Republican U.S. Rep. Mark Souder introduced the drug prohibition, which passed Congress in 1998.

"College students are adult enough to know that there are certain responsibilities that come with receiving funds from the American taxpayer," Souder said Monday in a statement. "The principle behind drug-free student loans is accountability, so as to help ensure that taxpayer funds are not wasted."

Students were first required to answer whether they had been convicted for possessing or selling drugs during the 2000-01 school year. The law was modified this year to only affect drug convictions that occur while students are attending college.

Critics say the law amounts to double jeopardy because it penalizes students twice for the same crime. Others say it unfairly affects poor students who depend on the financial assistance to attend college.

"There are scores of people around the country who commit any number of nondrug offenses, and the government doesn't stand in the way of their educations," said Adam Wolf, a lawyer representing a Ball State University student who is suing the federal government after she lost her financial aid for a year when police found marijuana in her car.

"The law doesn't deter drug use," he told The Indianapolis Star for a Monday story. "It deters an education."
First-time offenders lose their financial aid eligibility for a limited time. Those with multiple offenses can lose the assistance indefinitely.

IUPUI student Tonisha Mauldin worried she would have to drop out of school after police found marijuana in her apartment.

The 19-year-old Muncie resident was spared a conviction in exchange for two years of probation and community service. While she acknowledges that students who are found with drugs should be punished, Mauldin said the law is too harsh.

"I really don't think it's fair," Mauldin said. "(It) has to do with the rest of our lives."

When Shawn Heller and Brian Gralnick joined Students for Sensible Drug Policy in 1998, as sophomores at George Washington University, SSDP was just a handful of students from Rochester Institute of Technology. One of them, Kris Lotlikar, was working in Washington, D.C. at the Drug Reform Coordination Network. Heller met Lotlikar and started the second SSDP chapter, which soon included Gralnick. Their focus was decriminalizing marijuana for medical purposes - until Rep. Mark Souder (R-Ind,) decided to target college students with drug convictions who were seeking federal loans. In October 1998, a law was passed as part of the Higher Education Act that prohibits any applicant with an adult drug conviction from receiving federal financial aid. You can murder, maim and molest and still get federal financial aid for college.
But get caught smoking a joint, and you have to pay your own way; if you can afford it, that is.

The Higher Education Act was established in 1965 as one of President Lyndon Johnson's "Great Society" initiatives. It created federal programs such as the Perkins and Plus Loans, Pell Grants and work-study programs.

The goal was to provide enough financial assistance to those unable to afford college to have the financial resources necessary to attend school and seek a degree.

It did not deny aid based on drug use; if it had, many of today's leaders in politics, business and social reform never would have passed the test.

When Bill Clinton was President, students were able to avoid the issue altogether. The question on their financial aid applications asked whether the student had "never been convicted of any illegal drug offense." Many considered the wording of the question confusing, and around 279,000 applicants left the question blank.

The Clinton Administration simply opted not to enforce the provision and let the blanks count as "no." But to those who checked "yes" on the form, 9,114 lost their aid.

But the Bush Administration recently announced it would begin to enforce the law. The recently revamped financial aid applications now have a bold flag: DO NOT LEAVE QUESTION 35 BLANK

Of course there is one way to beat the system.

Lie.

Very few applications are checked at the federal level and financial aid administrators at individual colleges and universities often don't have the resources to conduct criminal background checks.

Rep. Souder in 1996 voted for the Chrysler-Berman Amendment to H.R.2202. It was a vote in favor of a chain migration system that has been the primary cause of annual immigration levels snowballing from less than 300,000 in 1965 to around a million today. Rep. Souder supported provisions that allow immigrants to send for their adult relatives. Then each of those relatives can send for their and their spouse's adult relatives, creating a never-ending and ever-growing chain.

Rep. Souder voted IN FAVOR of the Pombo Amendment to H.R.2202. He was voting for a massive new program that would have allowed agri-business to import up to 250,000 foreign farm workers each year for a period of service of less than a year.

Souder Voted to authorize the use of troops on the border in 1999
Rep. Souder voted in favor of the Traficant amendment to H.R. 1401. This amendment authorized the Secretary of Defense, under certain circumstances, to assign members of the Armed Forces to assist the Border Patrol and Customs Service only in drug interdiction and counter terrorism activities along our borders. The Traficant amendment passed by a vote of 242 to 181.
