What about 'Man on Street'? Pulled over for speeding a bit, or walking down a boardwalk after leaving the bar and the cop thinks you may be a bit too hammered, do you really want to be confrontational and invoke 5th amendment protection? Judge each situation as you come to it, best advice I can shoot most of you is if you do have to talk to the police, keep it as short as you possibly can. If the cuffs come out, thats definitely time to shut up, but don't start out by shooting yourself in the foot.

I think people forget to quickly that the police can and will lie to you at any time to get you to talk, especially young people.
I hope no one is ever the car in front of a cop like that guy, the ones who will follow you as long as they can untill you fuck up in some way, running your plates and just generally toying with you. Shits a real cat and mouse game-find a gas station or your house as soon as possible.

How about this guy... from a few years back....
In his first media interview in three years, Hiibel told Wired News he hoped "the Supreme Court will uphold the Constitution and the Bill of Rights and that all Americans, not just me, have the right to privacy."
"I feel quite strongly I have a right to remain silent and I didn't commit a crime," Hiibel said. "(The deputy) demanded my papers. I exerted my rights as a free American and I was cuffed and taken to jail."
Harriet Cummings, one of three Nevada public defenders working on the case, said that while the case might seem like "no big deal," the legal issues at stake are huge.
"This goes to the very nature of what our society is going to be like," Cummings said. "We believe that exercising your right to remain silent should not be something that can cause you to be imprisoned."
"If an officer acting under suspicion that a crime has been committed comes up to a person, starts asking questions and demands identification, and if the person, as Mr. Hiibel did, declines that demand, they can be hauled off to jail," Cummings said. "And we think that is not something that should happen in a free society."
No one should never, ever, under any circumstances, talk with the police -- guilty or innocent, a suspect or not; even if they THINK they are smarter than Aristotle and Newton combined, articulate as all get out, an expert in the law, and pure as the wind-driven snow. Never.

The only thing Police should be writing in their little note books is that the accused said, "Nothing" and that's still saying,"Something".
While a suspect's silence may be SOMETHING from the standpoint of the police investigation, it is NOTHING as far evidence that can be used in court.
Here in the US, your silence, or your refusal to cooperate in the investigation, can not be used against you in court. A lie however, can.
It may be better to be silent, so as not to accidentally provide false information to the police.
