My sentencing hearing begins

Last chance to help keep me out of jail!
by David Malmo-Levine - Monday, September 14 2009
In the shadow of Marc's battle with the US government, a smaller drama is unfolding here in Vancouver. I am being sentenced for three counts of s. 5(2) of the Controlled Drug and Substances Act (CDSA). Two of the counts are possession of cannabis for the purposes of trafficking and the third count is possession of psilocybin for the purposes of trafficking.
These charges were in relation to an organization I co-founded called the "Herb School". We had organic cultivation classes and daily drugwar history walking tours and we sold lots and lots of useful herbs, including the best cannabis, hashish and mushrooms in the city. We had a mini museum and promoted and paid for the rallies after Marc got busted. Here are some links about the School:

Speaking to sentence
Judge Joseph Galati - Vancouver Provincial Court
222 Main St, Vancouver, BC, Canada October 2, 2009
Your Honor,
The defendant would first like to thank you for giving him the three days instead of the usual one day, and allowing him to cross examine his witness, allowing Dr. Grinspoon’s magic mushroom evidence to be entered, allowing the defendant the time to say what he needs to say, and allowing him the time to get his thoughts in order for today. By giving him the opportunity to speak his truth you do justice a great service. You have been very flexible and I thank you for it.
Secondly I would like to provide for you the correct quote and the correct source of that quote I mentioned earlier:
“Laws do not persuade just because they threaten.” -- Seneca, roman philosopher, statesman and dramatist who was a contemporary of Jesus Christ.
I would like to now propose three different sentencing options and discuss the predictable outcomes of those options.

This is an overveiw of day two of Davids hearing;
Dr, Grinspoon, a proffesor and head of phychiatry at Harvard, was sworn in and testified by telephone from his home in Boston.
He was asked if there were differences between herbal and pharmaceutical medicines.
He said that unlike herbs, pharmaceuticals are subject to very stringent standards of approval, primarily because of the devestating birth defects that were caused in the fifties by thalidimide. Thalidimide was a relaxant, as was cannabis, but cannabis had been removed from the pharmacopia in 1941 as a result of the reefer madness scare tactics and the essential banning of hemp with the marijuana tax act of 1937.

In addition to adjusting eating habits and diet, some people find they need appetite stimulants in order to maintain weight and good nutrition. Many people believe that marijuana may be useful to stimulate appetite and calm the stomach. Smoking marijuana can be hard on the lungs so some people prefer baking it into brownies or truffles.
Thalidomide v Cannabis
Thalidomide: New Results
In January, a thalidomide developer, Celgene, of Warren, New Jersey, announced that the data from its trial in 99 people with AIDS wasting showed a statistically significant weight gain. The company seems to have "jumped the gun," as one person close to the trial put it. No data were yet available from the trial to justify Celgene's press release.
Drug company rebuked for marketing thalidomide as cancer fighter
In 1957, the drug thalidomide was approved for use in Europe as a treatment for morning sickness caused by pregnancy. Thousands of women took the pills, assured by the drug maker that they were safe.
Unfortunately, the drugs had primarily been tested as a sleep aid for elderly patients -- not on pregnant women. By the time its tragic side effects were known, it was too late to help the than 12,000 babies born with severe birth defects.
Today, it is known that even one capsule of thalidomide can cause devastating defects, including the development of flipper-like limbs.
Yet, the Celgene Corporation has promoted the pill as a cancer treatment, despite warnings from the FDA.
