Arresting Developments In Vancouver Three Case
Unusual Canadian Law May Block Extradition.

At the very least, this action puts the Canadian government,
especially Justice Minister Irwin Cotler, in a no-win situation.

Steve Tuck is filing an appeal of his departure order next week. We have discovered serious violations of Canadian law by the RCMP and the so-called Canadian Border Services Agency in collusion with the DEA. When Canadians find out the crimes being committed in their names, Tuck’s case will be a national scandal.

Immigration Canada would accept only the opinion of a specialist of their own choosing. But they refused to appoint any such specialist! In other words, because they refused to appoint anyone, there is no acceptable Canadian medical opinion on Steve’s condition. And now they try to blame him for having “provided insufficient medical evidence.”

There are none so blind as those who refuse even to look.

Pot TV News anchor Steve Kubby: in custody! American med-pot refugees Steve Kubby and Steve Tuck are currently being held by Canadian immigration officials after the pair were picked up earlier today. Kubby, the 54 year old founder of the American Medical Marijuana Association and host of the Pot-TV news with his wife Michele, suffers from adrenal cancer which he keeps in remission thorugh the use of cannabis. Kubby has recently been subject to a great deal of media attention, with articles in the local Coast Reporter newspaper, the Vancouver Sun and Province newspapers, CBC TV and a recent interview with Fox National News.

Report From Michele Kubby
From Hope on April 16, 2002

Sechelt, BC. At 930 am PST, Canadian immigration, along with RCMP officers showed up at the Kubby and Tuck residences to take both men into custody.

Michele Kubby and Lucy Tuck remain free.

The Kubby and Tuck immigration attorney has informed us that both men must have a hearing within 48 hrs. The hearing likely will take place in Vancouver. Both men could potentially be held overnight.

These raids seem to have started because of the recent media attention on Canadian national TV, local papers, and FOX TV news.

The seriousness of the situation has to do with Steve Kubby. Because Steve Tuck uses approved medications, he was able to take his medications with him.

Steve K. is again in a life and death situation while in custody. The officers would not allow him to take any medicine with him, nor would they allow him to medicate before he left. We have potentially only hours to save him.

What worked before was massive intervention. We need your help. Steve's life is on the line.

Two U.S. Medical Marijuana Refugees Taken From Their Homes On The Sunshine Coast Yesterday. One is in life threatening danger while in custody.

Sunshine Coast, BC, April 17, 2002- Steve Kubby and Steve Tuck, both medical marijuana patients from the US, were taken from their family homes by police on the Sunshine coast early yesterday. Both came to Canada to escape persecution for the medicinal use of cannabis. The arrests followed recent media attention, which many believe caused increased pressure from the US tohave them sent back.

Steve Kubby has Phoechromocytoma, a rare form of cancer. He was given a prognosis of 6 months to live, 26 years ago. Steve Kubby is a medical miracle. Cannabis is the only medicine that controls Kubby's potentially fatal symptoms. The cancer causes the adrenal gland tissue to quickly replicate, and creates adrenaline levels 10-20 times those of a healthy adult. Cannabis prevents the replication of the abnormal cells and stops the secretion of the deadly adrenaline. If Kubby is held in custody without access to cannabis until Thursday, the day he is set to appear in provincial court, he may suffer serious or fatal health consequences.

Michelle Kubby, Steve's wife, is a force to be reckoned with.

"My husband is a walking time bomb. Cannabis is the only medicine that deals effectively with the life threatening symptoms of his disease. We are here legally, he is a legitimate medical patient being treated as a cross border criminal. It is irresponsible and unacceptable to put his life in danger because of a prejudice against a plant."
Steve Tuck has charges pending in California for the distribution of medical cannabis to patients who have the legal right to posses the forbidden medicine. He was wounded in the line of duty while serving in the US army. Tuck is being persecuted by both Canadian and United States governments for his use and advocacy of medicinal cannabis. The police took Steve Tuck to the hospital for medical attention after his arrest, before he was taken into custody in Vancouver.

The local community is outraged. Hilary Black, founder and spokesperson for the BC Compassion Club Society that distributes medical cannabis, is very aware of the political situation.

"These men and their families are caught in a civil war between the State of California, where the medical use of cannabis is legal, and their Federal government which is oppressing patients with all of their political might. We must not bow to US pressure to persecute these families. Steve Kubby is now a political prisoner who could die without access to cannabis. Are Canadians prepared to give Steve Kubby a death sentence?

He must be released immediately."

Here is what you can do to help:

1. If you live in the Vancouver area, please attend their hearing. It is set for this Thursday, April 18th at 9AM at the Immigration Courthouse, which is located at 300 W. Georgia street in downtown Vancouver. We are organizing a rally outside the courthouse. It is important that we pack the courtroom in order to show our support for Steve Tuck and Steve Kubby! Please join us if you can!
2. Call Immigration supervisor, Mr. Kanuit at 604-666-6790 and tell him that medical cannabis patient, Steve Kubby requires his cannabis medicine while in the custody of Immigration Authorities in order to keep his adrenal cancer under control. His life depends on it!
3. Please spread this information far and wide!

Thank you for your support! In unity & love,

Medical Marijuana Awareness Day on the Sunshine Coast
By FlashGordon May 29, 2002
Shortly after Steve Tuck his wife and son arrived and the joy of his release on bail was infectious and spread more wildly when the Kubby's and their children too showed up and joined the crew beside the hall glad to be free. They had a harrowing experience in general lock up and although treated well by the officers that arrested them had been abused by the corporals and guards in lock up their medical needs not well taken care of transferred from one shit, piss, vomit and cum filled drunk tank into another at first and when Kubby banged on the wall because his blood pressure was peaking out the guards had threatened to beat him.

Tuck, suffering from morphine withdrawal had stood up for him, getting between him and the guards warning that at least one of them would end up cold as a cucumber if they tried to hurt his cell mate. On the second day when Steve Tuck was pissing blood and Kubby spiting up blood and Tuck was losing hope Kubby reminded him of the higher calling the two hunger striking prisoners were called to and that the sacrificed they were making to the movement were their payment in blood and that they would be remembered and change would come.

Three US Medical Marijuana Refugees Detained in British Colombia
In the last few years, British Colombia has replaced Amsterdam as the refuge of choice for cannabis culture refugees fleeing oppression in the United States. Lured by the scenic beauty, civilized popular attitudes toward marijuana, and a government that generally reflects those attitudes, the flow of American expatriates into British Colombia has steadily increased. But a series of arrests of prominent medical marijuana refugees in the last two weeks suggests that the Canadian government, feeling the heat from its southern neighbor, is ready to crack down on the growing colony of Americans who have settled in British Colombia.

I wanted to write-in here and tell everybody that I have several thousand research papers about cannabis finally posted online for those who wish to study or site them in papers, etc. This has been a hell-of-a lot of work but I believe that only by shoving the truth down their throats will we ever have a prayer of being free.
Peace, Steve Tuck

U.S. Drug War's Target: A New Mom

Gorgeous, guileless and naturally blissed out, Vancouver's Renee Boje, 32, is the perfect poster girl for pot activists; she's also a new mother and martyr for a cause she never dreamed she'd represent, a marijuana madonna with everyone from Noam Chomsky to Woody Harrelson writing letters on her behalf.

Ganjawarnews: 5-31-4 WE WILL NOT FORGET!

Stop The Federal War On Medical Marijuana by Dr. Andrew Weil
TODAY, in dozens of cities and towns across the United States, something remarkable happened: Thousands of people battling cancer, AIDS and other terrible illnesses, their families, friends and supporters delivered cease-and-desist orders to the federal Drug Enforcement Administration to stop it from blocking their access to a needed medication.

Their request was so simple, so obviously correct that it is heartbreaking that people -- many very seriously ill -- were forced to deliver their message in this way, with many risking arrest. But as individuals who have found that medical marijuana relieves their symptoms when conventional medicines fail, they felt they had no choice: The federal government continues to fight an irrational war against medical marijuana, and the sick and struggling are its principal victims.

Make no mistake: The government's demonization of marijuana is irrational. When I first published a study in the journal, Science, on marijuana's physical and psychological effects back in 1968, I was certain that medical use of the plant would be legal within five years. This is, after all, a medicinal plant for which no fatal dose has ever been established and that has been used in folk medicine for millennia.

DEAth Snatches Steve Tuck

Pot Shots By FRED GARDNER October 8 / 9, 2005
Does the Controlled Substances Act Mean What It Says?

DEA Snatches Steve Tuck

Steve Tuck is a Gulf War vet with a damaged spine who grew and distributed medicinal cannabis in Humboldt County after the passage of Prop 215.

His stated goal was to develop strains suited to treating various medical conditions. After being busted for cultivation in 2002, he moved to Canada.

On Thursday, reports Richard Cowan:

"Steve Tuck was taken in handcuffs by Canadian Border Services Enforcement officers out of his emergency room bed and driven to the US border.

He was in great pain this morning, and was partially sedated, but he was aware of what was happening to him. The great risk is that he will be taken into federal custody (in the U.S.), which he might not survive because they will not let him have cannabis under any circumstances.

"The essence of Tuck's refugee appeal was that he would be happy to return to the US, if he only faced state charges for growing medical cannabis in Humboldt County. Canada refused to show any interest in finding the answer to that simple question. If Steve is taken into federal custody, it will be obvious that Canada knew the answer, but withheld it from Tuck. If he is not taken into Federal custody, Immigration Canada will have wasted vast sums of Canadian taxpayers' money by not getting an answer to a fair question."

REFUGEE ROUNDUP IN B.C. by Chris Bennett 2002-06-18
The second refugee arrested was Steve Tuck, 34, who faces six trafficking and cultivation charges in Humboldt County, CA. He beat similar charges two years earlier based upon medical necessity. Steel plates in a once-broken back leave him in so much pain that he has been legally prescribed opiates for four years. However, marijuana allows Tuck to use fewer painkillers and lead a relatively normal life.

Marijuana smokers are filling jails with cheap labour for corporate profit.

Pot 'Refugee' On Way To U.S. After Hopes Dashed
October 08, 2005 at 12:03:51 PT
By Ian Mulgrew, Vancouver Sun *
Vancouver, B.C. -- Moments after Steven Tuck regained consciousness Friday, Canadian border security officers slapped him in handcuffs and whisked him out of St. Paul's Hospital emergency ward, catheter and all. One of a number of high-profile American medical marijuana refugees, Tuck's hopes of an 11th-hour appeal halting his return to the U.S were dashed.

Steve Tuck Released To Get Medical Care

Steve Tuck Released From Custody To Get Medical Care.
Must Report To Humboldt to Face Charges for Growing Medical Cannabis After He Gets Out of the Hospital.
His Health Has Been Badly Damaged.

Posted by*Richard Cowan on*2005-10-12 00:00:00

Beyond belief!! The Seattle jail is refusing to release Steve because of a mix up in the paperwork. Kafka? Vogon? No, its just the drugwar in DEAland! Steve's attorney, Douglas Hiatt, is apoplectic. He is standing by to take Steve to the hospital, but now he is going to have to endure another night in a jail that has a "policy" against giving any "narcotics." Presumably, they also have a policy against medical ethics.

My apologies for the incorrect report but the Associated Press is also carrying the story with the correction. They had been told that Steve had been released. Will the media ignore this outrage? Demand that the Congress and the Parliament investigate the torture of Steve Tuck!

Judge Releases Patient Arrested in B.C. Hospital By Gene Johnson

Seattle, WA -- A U.S. Army veteran who fled to Canada to avoid prosecution because he grew marijuana to help control chronic pain was yanked from a hospital by Canadian authorities, driven to the U.S. border with a catheter still attached, and turned over to U.S. officials – who provided him with no medical treatment for five days, his lawyer said.
Steven William Tuck, 38, was still fitted with the urinary catheter when he shuffled into U.S. District Court for a detention hearing Wednesday, said his lawyer, Douglas Hiatt.

We do not yet know when Steve will be physically able to return to Humboldt, but at that time we will need to be vigilant to see that he is safe. He needs a place to stay there, and it may be necessary to raise bail for him, perhaps $20,000.*

Patient Arrested at Canadian Hospital Released
By Gene Johnson October 13, 2005, Associated Press
Seattle, WA -- An American medical-marijuana advocate who says he was arrested at a Canadian hospital while waiting to be admitted for prostate surgery, turned over to U.S. authorities and held for several days without having his catheter removed was released from a Seattle jail to seek medical care Thursday.

"The whole time I was in jail, they put a blood-pressure cuff on me. That was all," Steven William Tuck, crying and shaking, said after his release.

His lawyer, Douglas Hiatt, and the president of Washington Physicians for Social Responsibility, Sunil Aggarwal, brought him to Harborview Medical Center, where he was being evaluated in the emergency room Thursday night.

"The doctors are appalled at the condition he's in," Hiatt said

The influence of marijuana as a cause of crime would be hard to overestimate.* With the victim experiencing hallucination and violent rages, he is likely to run-amuck and commit crimes he would not have nerve enough to attempt if he were in his right mind.

New Low

War on Drugs Hits New Low By Jordan Smith
Austin Chronicle November 23, 2005*USA
The federal war on medi-pot patients hit a new low last month when Royal Canadian Mounted Police nabbed 38-year-old Steven W. Tuck from his Vancouver, B.C., hospital bed, whisked him to the border, and relinquished him to the custody of U.S. officials, who wanted him on charges related to a 2001 marijuana bust in California. Tuck, an Army vet, uses marijuana to help treat chronic pain associated with injuries he received in a parachuting accident back in the 1980s.

Jonathan Magbie Vigil

A Searing Portrait of Abuse By Colbert I. King
Washington Post November 25, 2005*Washington, D.C.
This is the 12th column to be written about Jonathan Magbie, a 27-year-old man who was paralyzed from the neck down at age 4 after being struck by a drunk driver. Magbie lived at home with his mother, needed private nursing care at least 20 hours a day and was totally dependent upon others because he couldn't use any of his limbs. He got around in a motorized wheelchair that he operated with his mouth, and his breathing was aided by a tracheotomy tube and an implanted diaphragmatic pacemaker.

MCNAMARA TELLS CALIFORNIA TO STOP ARRESTING USERS!
AND TO OFFER VOLUNTARY TREATMENT INSTEAD

Restore-Digest V2002 #204 September 26, 2002
Sacramento: Retired San Jose Police Chief, and Hoover Institution Research Fellow Joseph D. McNamara testified as an expert witness on California's drug and alcohol policies at a hearing held by the Little Hoover Commission on State Government.

McNamara quoted a study originating from the National Academy of Sciences declaring that the lack of adequate data to judge the impact of the nation's drug policies was "unconscionable. "

McNamara said the same may be said of California's policies, and the state's current fiscal problems call for changes in an expensive and failing drug policy.

He said that using the police in a doomed effort to stop people from using drugs in private resulted in less enforcement for serious crimes and discriminated against Hispanics, African-Americans and young people.

Stigmatizing all drug users as criminals and locking them up, damages their futures, and harms families, communities and all of California, according to McNamara.
