Reporting Probation
Can you guys help me out and describe to me what may happen to me if I get reporting probation for a DUI? I got arrested after having been pulled over and failed a field sobriety test. I STUPIDLY admitted having taken a vicodin for a headache 4 hours before driving from a year old prescription of mine. Anyway, I have a lawyer and I understand I may get reporting probation. The problem is that I don't want to stop getting high for 6 months-a year. You feel me? So, my first question is do I need to be clean for my pre-trial (in case the judge wants a test then)? And if it gets that far do I need to be clean for my trial? If I get a probation officer, do I only need to worry about having to piss when I meet with them or will they call me in randomly? Mind you, I live in a big city and this is a total chicken shit case. These fucking pigs in this little township hassled me one night. These shithead cops get it in their heads they're going to bust you and there's no getting it out. They didn't even find anything in my car, on me, or in my purse. Anyway, I have already read all your advice on hydrating myself and taking B-vitamins, so thank you retroactively for the advice. I should probably add that I came to the right place for information, but I don't smoke weed anymore (not opposed to it of course). I do, however, pop a lot of opiate pills, xanex, and vallium. So, can anyone out there just give me the low down on reporting probation? Thanks ahead of time!

Depends on where you live and how strict they are on drinking and driving. In Virgina/DC/MD they rape the shit out of you.
Mandatory suspended license for 1 year, 1 year pro, mandatory enrollment in Alcohol Substance Abuse Prevention classes. Plus fines and fees totaling over $5,000 and 4 years of high risk insurance. If this is your first time and you have a clean record, they'll give you probation but not they won't drug test you right away at the court house, but they eventually may. If I were you I would start building a good defense do some voluntary community service and get some character reference letters from a Pastor, Professor or even the people you do the community service with. Start going to AA/NA meeting and keep track of the dates & get some to sign that you were there for proof. Then take some driver improvement classes, you'll get points added to your license plus your insurance company may even give a discount on your policy rate. Most importantly this will show you are responsible and know you made a mistake but are taking actions to clean up your mistake. This will impress the Judge and Prosecutor who may even give you deal or drop the charges to something lesser charge. Use all your resources. I know this sounds like a lot but trust me it's better then showing up empty handed. Balls in your court, they have a case regardless of what you may think. They Judge will always side with the prosecutor & L.E. unless you can prove with out a doubt that there was some foul play, which is rare. Last edited by JonBlaze; 02-08-2008 at 09:37 AM. |

It's simple: don't use drugs during the time of your probation. It sounds like you need a break anyway; sorry to be straight-forward but this is only my personal opinion. Now, my advice to you is to find a routine within your probation to use to suit you. Smoke a couple of days after your probation visit, and then stop.

So, if I don't want to be clean?
OK. I know you two are right...I need to be clean during my probation (if I get it), but let's pretend I don't want to be. I think we all can relate to that. Does anyone have any advice to my original inquiry?
