PIERRE, South Dakota (AP) -- State lawmakers voted Friday to ban nearly all abortions in South Dakota and sent the measure to the governor, who said he is inclined to sign it.

Under the legislation, doctors in South Dakota would face up to five years in prison for performing an abortion unless it was necessary to save the woman's life.

The bill directly targets Roe v. Wade, the 1973 U.S. Supreme Court decision that legalized abortion. State lawmakers believe the nation's highest court is now more likely to reverse itself on the abortion issue because of the recent appointments of Justices John Roberts and Samuel Alito.

Planned Parenthood, which operates the only clinic performing abortions in South Dakota, has pledged to challenge the measure in court if Gov. Mike Rounds signs it into law.

"I've indicated I'm pro-life, and I do believe abortion is wrong and that we should do everything we can to save lives," Rounds said before the vote Friday in the House. "If this bill accomplishes that, then I am inclined to sign the bill into law."

The bill passed both houses of the Legislature earlier in the session, but the House had to agree to a Senate amendment. It passed 50-18.

The new restriction would become law July 1.

Opponents of the bill argued that abortion should at least be allowed in cases involving rape, incest and a threat to a women's health.

If a woman who is raped becomes pregnant, the rapist would have the same rights to the child as the mother, said Krista Heeren-Graber, executive director of the South Dakota Network Against Family Violence and Sexual Assault.

"The idea the rapist could be in the child's life ... makes the woman very, very fearful. Sometimes they need to have choice," Heeren-Graber said.

Kathi Di Nicola, a spokeswoman for Planned Parenthood of Greater Iowa in Sioux City, said her clinic already serves some South Dakotans and is ready to assist others if needed. The Planned Parenthood clinic in South Dakota has performed about 800 abortions a year.

I know many people from South Dakota and they aren't psychopaths. Wanting to not kill things is not psychotic.

Good to know that I'll never be visiting South Dakota - what a bunch a wacko representatives.

As long as it stays a states-rights issue, I'm fine. It irks me that they're trying to bring it back up in front of the Supreme Court.

Sorry, let me try to say this in a calm, unthreatening way..

Abortion is not killing.

A fetus is not a person.

A woman living on minimum wage with three other kids and no man to help should not be forced to have another child.

A woman who is impregnated by a rapist, under ANY circumstances, should not be forced to have that baby. S.D. won't even give the pro choicers that much.

Oh, and Derexan, I agree with you to a point, but I think abortion is an issue that the Feds got right.

You cant kill something that is not alive. Thats like saving all your sperm because you dont want to waste what could have been.

please explain to me how removing an unborn fetus is murder in any way.

lets assume an unborn fetus is a living breathing human just like you and me. shooting someone with a gun while in iraq is a whole different story. your not being hypocritical are you derexan? you believe killing a human is ok if its in the name of war?

well whether or not abortion is killing really depends on when its aborted..
a sperm and an almost fully developed baby is a huge difference and you cannot compare the two.

we are talking about people who are within the first trimester here, i am assuming. not too many people choose to abort their baby past the first 3 months. I cant support the abortion of a living being that is percieving the world around it and has emotions, needs, etc.

not all choices should be legal...(like murder and rape and such)

this is also the majority feeling in south dakota...so making it illegal IS THEIR CHOICE. I agree as long as it stays a state issue.

the select few making the law? the select few that give a shit about the law? the select few who are on a crusade to change the law? why should they have any say in the matter? they arent the ones with little baby humans developing inside their stomaces.

lets leave the choice to the people who actually have to make the choice between letting go of their potential baby or not. i cant believe you think just because a majority of the population agrees on something it should be made reality. thats how we got into that whole "racism" mess remember?

this whole issue is based on the argument that an unborn fetus is a living thing. while that might be true past a certain period of time(it should be illegal to abort your baby when it is its own human, by the way) in most cases the fetus wouldnt even be past ZYGOTE stage.

theres actually 754,844 people living in south dakota. and each of them has their own opinion on wether or not its ok to abort kids. so why should we create a law that assumes one position is right without proper scientific backup?

because a lot of people don't base all their decisions off of science. south dakota happens to be a quite heavily christian state.
