Wondering if anyone has any advice for handling a simple possession charge.

I didnt have anything in my hands, wasn't doing anything illegal, had 2 cops approach me (I was drunk, sitting in the grass in front of a house, no open containers, and Im over 21) and search me. I had ~3 grams on me.

Money is an issue, and I need my license for work.
any help'd be great.

Ask for a public defender.

when they say if you cannot afford an attorney one will be appointed to you by the court of law they're not joking.

they might be great and as devoted/serious about your case but if your well informed enough and tell them what you want to do you'll be fine.

make sure you tell your attorney to tell the law that you did not consent to a search

DO NOT UNDER ANY CIRCUMSTANCE TAKE A DRUG DIVERSION CLASS OF ANY KIND, EVER!

I know its tough when they offer up a class and a fine if you plead down but thats strongarming you into compliance. Public defenders are quick to plead you out no matter what since they have a huge caseload and are looking to clear them out at whatever cost. That cost is your freedom. You may not go to jail but having to pee in a cup for some guy or having someone hold your prior conviction over your head making sure you toe line is certainly not free. In this case its all or nothing, either you convict and jail me or its over and done, no probation or court mandated classes or tests or nothing.

By the way, what backwards ass state do you live in where 3 grams justifies the cost of your detainment? Here we have cops give back that little amount of weed and tell us to have a nice day.

on your property you can damned well do as you please.

no warrant (on your property) search was illegal, unless they were called for public disturbance caused by you.

get a public defender and sue the arresting officer for false arrest, or false arrest based on illegal search.

I don't even think they could arrest you for an open container on your property, let alone a few crumbs of reefer.

Assuming your location is in virginia as listed, it depends. I live there, had paraphernalia and some stems on me about 9 months ago. I was searched and busted as a (sober) passenger in a friends car which was pulled over one night.

They told me I was charged for paraphernalia/possession, but issued no court ticket or warrant. Turns out the charges never amounted to anything or existed on record, even though my glass piece was confiscated by the 5-0. Lucky breaks happen if you're holding next to nothing at the time of the bust.
