Probably the most important question to ask an officer/cop: "Am I free to go?"
You only lose your rights when you stop exercising them.

Yeah man, fight The Man! How dare a Border Patrol Agent ask of what country you're a citizen, the NERVE of those guys! I was really hoping for a good traffic stop exercising-the-rights video, but this is just some guy being an asshole to someone who is just doing their job. And if you have a problem with being asked of what country you're a citizen, WHEN CROSSING A BORDER, maybe your retarded ass should have just stayed at home. That isn't fighting The Man, that right there is called being a difficult asshole for no reason other than to be a difficult asshole.

Agreed. This guy is just being an asshole to someone doing their job. You think she likes standing out there in the heat dealing with pricks like this everyday? Fuck dude, answer the question "do you live here" and move on. There's no "Man" here and I am baffled why you "commend this 'gentlemen'."

what happened to freedom? If you accept laws like these they will continue to pile them up, but if you resist by making it impossible for her to be "just doing her job" of curtailing freedom and collecting stats, then perhaps they will think before tracking your movements without cause. |

I'd say they were both retarded. She for not answering his question the first time he asked it and him for doing the same. And i guarantee you if it was some 200+lbs male border agent that the dude in the car would have been screaming "don't tase me bro" by the end of the clip.

Agreed. Just because someone has chosen to infringe my rights doesn't mean I have to be subservient to them because they don't know any better or they actually think what they are doing is patriotic and bold. Just "doing their job" doesn't make it right.

i just gotta say the guy started off being an asshole and all defensive and weird with the camera before she even asked him a question. i think he was a dipshit. to me, big effin deal. i live in usa, thanks, haveaniceday. not: am i being detained? am i being detained? am i free to go...fuckin dumb way to 'fight' for rights, imo.
edit: i get what u guys r saying, about saying as little as possible and all that, but i would think that guys strange defensive attitude would have made them want to search him, or detain him. they can, can't they? probable cause covers a broad spectrum of situations, no?

How hard would it have been for the officer of the law to respond that no, he was not being detained, and that yes, he was free to leave?
Neither are shining examples of humanity, but the interaction serves as a tutorial of sorts in how to exercise your rights. |

he would have gotten an answer if he approached it with less hostility and made it clear he wasn't being a dick, but merely knew his rights.
A simple, "Listen, I know my rights here, so let's just make this as easy as possible...if I'm not being detained, then I should be free to go. If I am being detained, then say so." shrug.

Thanks for posting that video, PS. I would agree with you that the one simple question, if answered, would have led to further questions until she had reason to feel suspicious. I just posted the video over at 911 blogger, by the way.
By the way, this might be a good time to review this most helpful video with regard to exercising your rights during even the most stressful police enounters: Most of us have likely seen this, but as the narrator says at the end: "...But do you really think this one-time viewing will prepare you for the pressure and confusion of an actual traffic stop, say, in a month or a year from now? Review this video often."

Bottom line here is...
The Supreme Court does not recognize detainment. The officer is on taxpayer's salary and has to answer to the gent in the car, not the other way around. I have done these things myself.
He obviously set out to do exactly what he did. He had his camera with him. He asked for the supervisor's name. Checkpoints have become commonplace during the Bush regime. Do not succumb to these, even if you have nothing to hide. They have been known to plant things. I have stood up to many authorative people in the past twenty years. I have cost some of them their jobs. That is the first thing I go after because they are not interested in public safety, only job security. This is why they so adamately support prohibitionist laws which keeps crime and drug dealers in place. I start asking for supervisors when they step on my rights. I tell the supervisor to remove them from the force or I will go to his/her supervisor. I wonder what kind of day the poor young lady had after he left. They put themselves in the position by choice. When you act politically, sometimes the situation gets awkward, especially when you get caught by surprise by someone who knows how to exercise his rights.
