an unregistered handgun

is a class B felony in my state if you carry it outside, but it's only a class A misdemeanour if you leave it in your house. My question is, what if someone broke into your house and you shot them with an illegal weapon? Would you get anything other than the misdemeanor charge or is there some kind of extra charge they can stick you with for using an illegal gun?

well look, an illegal weapon is trouble any way you look at it. If you need a gun and dont want to register, just get a shotgun.

you have to register ANY gun you own...if you shoot someone with that handgun, all the bodies or robberies and your tri state area will be looking your ass.

I live in New York Terry. I did live in Boston for awhile though, I can still conjure the accent back up when I'm drunk enough.

Getting a permit isn't really an option. Your county sheriff has to sign off here, you have to explain why you want it and even if you have a good reason most applications get rejected anyway.

You don't usually do time here for misdemeanor gun possession as long as you don't have any serious priors. I know you're legally allowed to shoot someone robbing your house, I really don't see how the status of the gun changes that.

One time in hs I remember I asked my Civics teacher about the whole,"Shooting people on your own property rumor." Yeah, she told me that it's illegal to defend your self of your property... She said how ever if they threaten your LIFE, then you have all rights to fuck them up.

So just make sure they look at you wrong, then you can shoot them.

As far as the gun being illegal, yeah I'm sure they would let you go with a misdemeanor after you just took some ones life rightfully...? It wouldn't exactly be something every one would be comfortable with.

Deadly force is the last resort!

Even the most justified self-defense shootings performed with legally obtained and owned firearms can sometimes be turned against the shooter. There have been plenty of cases where certain specifics pertaining to the case will end up being a deciding factor. One issue is the prevalence of custom hand-loaded cartridges people make for optimal performance will be legally misconstrued in court as a cartridge created by the shooter 'for the purpose of achieving maximum wounding capabilities.'

I would generally try to avoid any 'dirty' gun like the plague. ATF is a real bitch these days..

And as for Jake_Armstrong, you apparently have no attention to detail what so ever.

I said, it's not against the law to defend your self if you LIFE is threatened. But if its personal PROPERTY then it isn't legal. Such as if they are trying to steal your car. Or bathroom supplies and candy....

in california if someone breaks into your house and you fear for your life you can shoot them. but if there even 1 inch outside your house you can get charged with manslaughter. so remember guys, after u shoot them, make sure to move them into the house atleast a few inches.

how about unregistered AK-47s?
got half a dozen of them that I built from kits... all legal, mind you, with the correct number of American-made parts....
much more intimidating than ANY handgun... a small, black AK with 30 rounds of kickass hanging off the bottom of it. (Hungarian AMD-65)

I have a CCW (Carry Concealed Weapon) permit. In order to get one in my state I had to take a class, where this question came up. If someone breaks into your house, wielding say a knife, and you have a gun, you can *not* shoot them. However, if they break in wielding a gun, you have every right to fire away. You must however use only as much force as is being threatened against you. Also, my instructor basically said this, *if* you are shooting to kill (and this must be in order to prevent imminent harm to yourself or another person, not to protect property) make sure your shot/s are good enough to kill. If you shoot to wound, you are basically saying you didn't feel your life was threatened enough to shoot to kill.

If you leave the perp alive, you leave them with an opening to sue you in Civil court for damage/injuries even if they are breaking into YOUR house. It's fucked up, but it's true.

Sorry to bump an older thread, but you don't have to register your guns, unless they are a Class 3 NFA guns. I'm pretty sure its class 3, but anyways that means its either a machine gun, a short barreled rifle/shotgun or an AOW(any other weapon...). Silencers fit in there somewhere but I'm not sure so I don't know...

Most new guns are kinda registered with the 4473's. 4473's are papers that state who a gun shop sold a gun to, what kind it was etc.... And they have to keep these on hand for a number of years, upwards of 70 or forever from what I've heard. Some speculate(I, myself included) that these are going to be used to find guns in private hands when the man comes to take them...

About defending yourself from an intruder...

If someone is in your house, and you have a reason to beleive that they are going to either kill or cause major bodily hard to your person you have every right to shoot them. Now each state pretty much has their own version of that, some say you have to be corned in order to shoot them(ie:no viable means of escape). Either way, if someone breaks into my house and they threaten me I'm going to shoot them until they stop moving. Now by thread I mean, not only a person wielding a gun or knife or any weapon for that matter but like if someone is unarmed but charges me, they are getting the shit shot out of them.

Sorry. Here in PA you may not shoot someone to defend your property. Only your life. You have to show that you had cause to be afraid for your life. So empty the clip and do it fast. (It's evidence of a lack of presence of mind.)
