For sure, there is no good side of this. It's fucked up and that's about as good as it gets. Trying a 12 year old as an adult is truly fucked though. It takes time to learn how to be a person, twelve years just isn't enough to justify twice the time you've even been alive in prison (if it's 25 years = life sentance).

What the kid really needs is some heavy positive influence and people to talk to him to try and help him realise what he's done and to understand how truly wrong it is. And if he doesn't figure it out, and is truly and evil bastard, well...send him to iraq?

Ok the fact that he knew to hide the shell and throw it in the woods shows that he knew he did something wrong..

heh, you totally contradict yourself right here. how the hell is shape recognition an accurate indicator for determining someone perception of reality. That's like the most closed minded interpretation of a study I've ever heard, even from a scientific standpoint.

I was commenting beyond the barriers of the thread's subject matter and was focusing only on the content of your post itself.

this is like... a thread footnote. nay, something that supercedes the thread. A discussion beyond the focus, only possible in a place like this, an internet forum.

well no shit sherlock like I said malicious intent is evident he shot the bitch. the thing we are trying to determine now is the appropriate way to judge the case.

pretend you are a juror in the case. you want to cover all your bases the best you can. right?

saying "/ end thread" sure seems to me like rushing to judgment, more than likely based off of emotion than reason

Sorry, I didn't mean to be so vague.

Ok, when I said,"he knew he did something wrong." Even if he did it without even thinking about the consequences, he still did it. His brain could have some kind of deformity no one can see or know about, which is why he could have no recollection of the incident.

Therefore the same thing could happen when he's an adult.

Some people deserve to get killed, there's just no way around that fact. If someone is coming at you with intent to kill you, for instance, it's perfectly acceptable to kill that person in turn.

What I have a hard time grasping isn't that he understood the mechanics of death, but that he's at an age where he can make the distinction between a real threat and a perceived/non-physical threat. Even vengeance is excusable in some cases but you need to have a level head about it, something a child could never understand.
