got a DUI the other night...

was out with a bunch of friends the other night, had a few drinks, wound up leaving this girl's apartment at 5am with 2 friends in tow, got pulled over immediately and blew a .07 thank god, wasn't totally over just got an 'alert' warning, 3 day license suspension and car impounded.

im putting this here because i dont care about g&s, flame away, say whatever's on youre mind. i dont wanna preach, but regardless of whether youre straight to drive youre gonna have a few red lights flash when youre exhaling into a breathalyzer. it's not worth the risk, if nothing else but for money's sake...

basically if you blow .05>.08, the officer will evaluate you on tiredness, eye movements, ability to walk a straight line even if it is lower than what the threshold is. its all up to a jury, cop recount of situation, video, speach..etc

Most states have persumpted and per se laws.

Meaning, you can still get CHARGED with a DUI even if you blow under the legal limit.

the province that i live in canada, we have a new law that if you have ANY alcohol up until .07, you are registered as an "alert" which means you aren't technically 100% impaired, but are on youre way to it, and have obviously been drinking. first time offenders, 110$ ticket, 3 day license suspension, and car impounded

and no, im not a lightweight, in fact being a heavy drinker saved my ass or else i woulda blew over a .08 easy

Well, this is a clever way to collect revenue for DUI's without clogging the courts up.

Fine collected, offender is made to think about what happened, and there is virtually no administrative costs, if the offender chooses not to pursue getting the case dismissed.

Couple of other comments....

I am hard pressed to believe that a heavy drinker has the ability to metabolize alcohol any quicker then a social drinker. So, if someone can share something that proves otherwise, I would very much like to see it.

Breathalyzers read based on the amount of undigested alcohol in your body. Charges have been dismissed in the past based on the fact the the Def has burped just prior to the test being executed which would therefor produce a higher reading of alcohol content registering during the reading.

I think DUI Driving Under the Infuence,, ie being perceived incorrectly by some folks. Breath test are for booze alone...(you all knew that).

But so many people drive while stoned, tripping, or even on legal drugs ,

and blow a 0.0 on the booze horn, that the laws had to be changed to include "not drunk, but blind on something to the extent that you should not drive" type phrasing.



in 1973 I was arrested in Oklahoma for drunk walking. (minor fine only for servicemen)

i think the rate metabolism of alcohol has to do with a few factors:
genetics, body composition, and previous exposure to alcohol.

our bodies have an enzyme, or a few enzymes, called alcohol dehydrogenase (Adh). if your genetics code for an abundance of the enzyme, then you will have a natural tolerance because your cells can metabolize the alcohol more quickly due to an increase in the ammount of adh. drinking alot can cause your body to make multiple copies of the gene, or genes, that code for alcohol dehydrogenase, so being an alcohol can make your body better at processing the alcohol you are drinking. so yes, its possible that a hard drinking individual will be able to process alcohol more quickly than a novice drinker, but i dont think that will hold true in every single situation.
