Mailing cigarettes

My uncle lives in GA where my brand of cigarette (Newport) is about 5 dollars a pack cheaper than they are here in NY.

If he buys me a pack/carton as a gift and mails them to me is it illegal?

I've tried googling but I can't find a straight answer.

I'm heading to bed and I'm gonna call some places when I wake up, but if any of you know for sure in the meantime I'd appreciate it.

Man it would suck to smoke at NY rates with a job like yours.

It's bout time I hang up the packs for good myself. I quit once a year then justify restarting. even at 10 bucks a week thats still 520 a year that could be better spent.

I'd think transporting a gift would be different than mailing a gift when there is so much TAX involved... That's a good question though. It is a 'personal' limit for sure. Not like inter-state sales or anything.

I'd say just do it.

Most likely it'll come and no one will be the wiser. And the worst that can happen is they'll confiscate it.


That is if it's even illegal.

SUPPLEMENTARY INFORMATION:
On May 5, 2010, the Postal Service published a proposed rule Federal Register
(75 FR 24534-24541) to implement the Prevent All Cigarette Trafficking (PACT) Act of
2009, Pub. L. No. 111-154. The Act’s purposes include requiring Internet-based and
other remote sellers of cigarettes and smokeless tobacco to comply with laws applied to
other tobacco retailers by:
• creating disincentives for the illegal smuggling of tobacco products;
• enhancing enforcement tools to deal with cigarette smuggling;
• stemming trafficking, which increases the collection of federal, state, and
local excise taxes on cigarettes and smokeless tobacco; and
• preventing youth access through Internet and contraband sales.

Section 3 of the PACT Act pertains to the Postal Service and creates a new
Section 1716E of Title 18, U.S. Code. Section 3 of the PACT Act provides that, subject to certain exceptions, cigarettes, including roll-your-own tobacco and smokeless tobacco are nonmailable.
Exceptions in the PACT Act permit the mailing of cigarettes
and/or smokeless tobacco in narrowly defined circumstances, as described below.
• Noncontiguous States: intrastate shipments within Alaska or Hawaii;
• Business/Regulatory Purposes: shipments transmitted between verified
and authorized tobacco industry businesses for business purposes, or
between such businesses and federal or state agencies for regulatory purposes;
• Certain Individuals: infrequent, lightweight shipments mailed between adult individuals;
Tl:dr the government wants more taxes, so it's illegal to mail tobacco. However, it's legal to mail probably a carton or so at a time every so often (read: not the same day every week).

I read that cigs now cost ~$10 a pack in NYC. Is that right? Fuck, I used to buy a carton for that!

I started chewing tobacco @ age 13 (gateway drug ) 46 years ago.

$0.23 a can back then + 2 cents tax. (same as cigarettes)

now it's 4 dollars a can.

last time i was in NYC i saw some dude may 13 dollars for a pack of newports lol.


idk why youd give your money to the tobacco giants / government when they rape you with costs any chance they can...

Quit or roll your own.

You can get like 2 cig packs worth of bugler tobacco for like 4 bucks here in expensive ass NJ...

and it is better tobacco than any pack cigarette as well...

The Seneca Nation is very highly represented in Buffalo. The second largest population of the people in the world. There are multiple reservations, some casinos, etc.
But the NY gov passed a law about 2 months ago that says they aren't allowed to sell cheap non-native smokes to non-natives anymore. So the 30 minute car ride there will save me next to nothing.

i can get lucky strikes for 20 a carton from isreal and up to 36 for benson and hedges. i ordered some camel blues for a friend once, 31.99 for a carton and free two week shipping.

A pdf that shows State rank for tobacco taxes and the amount each state charges. Bear in mind that is in addition to the Fed tax of $1.01

Average price for a pack of smokes nationwide is $5.58.

So, for those of you that still choose to pay someone to kill you, now you can figure out who has the best retail price in your local area.

So glad I quite smoking. Just over 2 years ago, so I've a saved a GRIP.

When I first smoked, a pack here in Ontario was like $4 now its $11 for the good ones.
