20-Year-old Chris Diaz is an asthma sufferer from Texas. After learning medical marijuana was a successful treatment for asthma, he headed to California seeking medical treatment. Diaz was approved for medical marijuana in California for his serious condition, so he stocked up on what he could afford and headed back to his home town in Texas.

He was pulled over on a Texas highway for having an expired license tag, a routine traffic stop. But when Diaz wasn't able to produce a drivers' license or proof of insurance this alerted the police officer. Already in custody for a criminal offense, the officer began to search Diaz's car. They found 14 grams of medical marijuana and hashish, medical marijuana is not legal in Texas nor do they recognize medical cannabis cards from other states.

Under Texas law, Marijuana possession of less then 2 ounces is a Class B misdemeanor that is punishable with fines and up to six months in jail. But the hash is a totally different story, possession of hashish is a Class 2 felony punishable by up to 20 years including fines if less then 4 grams. Diaz can only wish he was so lucky.

He is charged with possession of a controlled substance with intent to deliver, a half ounce must be "Big Time" in Texas. Diaz was indicted by a Brown County grand jury, and now he faces up to life in prison, and without his much needed medication. He is now in jail on a $40,000 bond awaiting trial.

Why is Texas so worried about a small amount of pot, so much to the extent to take someone's entire life away? Diaz's real crime was driving in an unregistered plates and without a license and insurance. Some stiff fines and community service will nip that in the bud, but to focus on some small amount of marijuana and treating him like a murder is just plain BS. No one is saying Diaz is innocent, but at the ripe age of 20 he deserves the opportunity to become a valuable citizen. Moral of the story is, stay away from Texas!

But yeah, what DH said. It's a terrible penalty and I disagree with that bullshit 100%, but like...wtf...drive all the way to Cali to get some med weed and then bring it back to Texas with an expired license plate (license tag = license plate?). Just, why?

I wonder if he was baked... Once when I was 19 my insurance had lapsed and I had to drive somewhere, all I remember was I was baked, had a gram on me and I was driving with bad plates. I was freaking out.

This is just one of many travesties that plays out on a daily basis.

We can only hope that the attention he can muster up will attract some high profile lawyer wlling to take it to the supreme court, where his case can be decided outside of Texas courts.

No doubt alot of huge amounts of cannabis are transported thru texas.
But I seriously doubt the mexican cartels are shipping 1/2 ounce quantities in individual single serving baggies. ( the type dispenseries use) Which is why the "intent" to distribute was slapped on.

But I agree, snubbing your nose at local laws, and then trying to circumvent them...not too bright.

Someone said this before, "you can never get away with doing two stupid things at the same time."

I really hope our justice system isn't going to royally screw him. I think a judge will be fair to him I don't see him getting life over this bs.

Hope he learns his lesson....... and gets a god damn haircut!!!!!

i kinda have to agree, I think the war on drugs is retarded but then again you have to wonder about a person who drives to California to just to buy marijuana and then drives it back to texas with no drivers license or insurance...

Its' called probable cause. People than sell drugs usually have more than a bit.

well you can make an assumption based on their past but you cant predict for certain what someone will do in the future. they could do a 180 and be like hmm no im going to flush this and go fly a kite. in all likely hood they will continue to do what they do. the thing is, is that intent to distribute is a charge that goes against innocent until proven guilty. that's how it used to work..

i mean fuck, this is an innocent life we are talking about. being caged until death.

Most likely the intent charge was the result of several small amounts of different strains, plus the hash. Makes you look like it's split up for resale (which it was at the dispensary).

Living in Texas...I'm not sure he's gonna get any breaks on this rap.

Weed does work as a remedy for asthma.

Which is kinda weird, you'd imagine inhaling burning plant material would make it worse.

So maybe the guy would have been wise to be a little more savvy and fly but I agree with profit- he's only seeking medicine, sucks that he should receive any penalty let alone life in jail.
