DENVER Judge Blocks Medical Marijuana Growing Rule
Judge says pot Growers can sell to more than 5 patients

A Denver District Court judge on Tuesday issued a preliminary injunction, blocking the state from enforcing a rule that says no grower of medical marijuana can provide it to more than five patients.

The ruling by Denver District Judge Larry Naves came after a five-hour hearing in a suit brought last month by 47-year-old Damien LaGoy.

LaGoy, who is suffering from AIDS and Hepatitis C, was denied permission from the state to obtain medical marijuana from his chosen supplier, because that supplier already had five approved clients.

The limit of five was not part of the state?s medical marijuana law as passed by voters in 2000, and was established instead as policy to implement that law by the Colorado Department of Public Health and Environment.

?The number five was really just pulled out of the blue,? said Brian Vicente, attorney for LaGoy and director of Sensible Colorado, a non-profit group which advocates on drug laws and policy.

LaGoy, who said medical marijuana is the only solution for relieving the crippling nausea caused by the regimen of pills he must take for his illnesses, filed his lawsuit against the state and numerous state officials June 22.

Tuesday?s preliminary injunction means not only that the five-patient limit now does not apply for now to LaGoy and his chosen provider; it applies to medical marijuana users and providers across the state.

?The state adopted this arbitrary policy saying that five is enough,? said Vicente. ?It?s tantamount to saying a doctor can only service five patients or a pharmacy can only service five patients at a time.?

Mark Salley, a spokesman for the Colorado Department of Public Health and Environment, said ?In light of the judge?s decision, we will be revisiting the policy and deciding how best to represent the intentions of the citizens of the State of Colorado.?

LaGoy, who testified at Tuesday?s hearing, was relieved at the decision.

?I?d like to thank the judge for probably, very possibly, saving my life,? said LaGoy, who former nurse?s aid who lives in Denver and survives on disability payments. ?Now, I can probably get some medical marijuana. I can start taking my meds I have been missing, and getting chastised by roommates, friends and doctors.?

Because Naves? ruling is a preliminary injunction, there could be further proceedings in LaGoy?s case ? unless the state now revises its policy in the wake of Tuesday?s court decision.

?The process from here,? Vicente said, ?is we?ll be applying for a summary judgment, asking the judge to basically rule (permanently) in our favor based on the testimony we?ve established so far.

?If that is not granted, we will go to trial, I would imagine, in the fall.?

This right here, is what makes me want to move to Colorado. I think it's awesome that it is such a forward thinking state, and realizes there isn't anything evil/harmful/shameful or mainly criminal about helping people that are suffering.

I can't wait for the day that every state follows suit. So, I applaud those that are fighting the good fight, and hope one day I can follow in their footsteps (got to get my own life straightened out before I can fight for others).

The governor was quite a go-getter for being a stoner. something i admire greatly but will likely not be able to resemble. thank goodness for him and people like him.

haha yeah right. I live in Co, its not exactly the pinnacle of modern thought. Its not even close to legal to smoke here. Cops will still get you for federal law.. so its close to worthless. Some cases are winning here so I just pray for a real change.. not really pray

Ken Gorman? the first person to show up at my apartment with pot for sell..when I first moved to colorado. Ken was a good person and his thoughts were right? his actions were not. Moreover, the way he went about it was not? If they were he would still be around today with a legal CO-OP. I knew Ken for almost 6yrs and could never get why he would sell to anyone! For Instance, I asked him once if he would sell to a 12yr old that he had over at his place and he stated "he probably needs it more then most people, yes I would if he asked". Ever since then " as a father of two teenage boys" I had to distance myself ethically from him. Knowing Ken was not just a Medical dealer but also a Drug dealer that was on a quick line for where he is at now. This is not the only instance that set his demise. Ken had a habit of just being plain stupid about who and how many people he had around him. I quit going around Ken because mostly of the gangsters he started to get quite affliated with. And also the statements he had made to me over the time I knew him. In short and with what I knew of Ken, I hate to say Ken is where Ken was headed and wanted to be! and only he knew it. It was Just a bit to early for most of us to comphrehend. I remember him saying once "Im only going to Die when I know for sure there is weed on the otherside". I hope he was right because I know there is weed still on earth and there will always be weed here,"at least some WonderBerry". And he could have made the Life choice if he only had wanted to. I just hope I get to see him again sometime and ask him why he was in such a hurry to be an unsolved murder victim. All I know is someone is out there with the reason still lurking among us Please help find him/her or them. In short we will have to move on with out Ken.

We used to e-mail each other back and forth and I was amazed that he was the only dude in the whole country I thought of as OPENLY out of the Cannabis Closet as I was. I find it funny that most poeple on here who praise him in death vilified him in life. ( I think a similar ulogy awaits me.)

It's been a long time since I visited YaHooka. I'm glad this was my first thread back. Gov was a great guy and I remember the day they took him from us. RIP old friend, you gave a lot of people help when they needed it most.
