ED ROSENTHAL RAIDED AND ARRESTED BY DEA

OAKLAND, CA -- Cannabis authority Ed Rosenthal was raided at 6 AM this Tuesday morning by DEA agents. Several witness said that Rosenthal was also arrested, but no official confirmation from the DEA has been forthcoming.

According to reports from California NORML Dale Gieringer and legal expert, Chris Conrad, the raid was still in progress, as of 10 AM and no county or state agencies appear to be involved. Unconfirmed reports indicate top 215 attorney William Panzer will be representing the 55 year-old author of the long-running "Ask Ed" column in High Times and Cannabis Culture.

The raid appears to be carefully timed to coincide with Asa Hutchinson's scheduled talk at the Commonwealth Club in nearby San Francisco.

"It sends a creepy message to the entire cannabis community," said Steve Kubby, who co-authored "Why Marijuana Should Be Legal," with Mr. Rosenthal.

Rosenthal has been taken down to DEA headquarters in San Francisco. The raid comes suspiciously on the same day as Asa Hutchinson's scheduled talk at the Commonwealth Club in San Francisco.

The raids coincide with the visit of DEA Chief Asa Hutchinson, who is scheduled to give a talk this evening at the Commonwealth Club on U.S. drug policy and it's implications for California. If you are in the San Francisco Area, please demonstrate your opposition to the fed's complete disregard for states' rights and the medical needs of the sick and dying by protesting DEA Chief Asa Hutchinson's visit to California. The DEA is in the process of busting a marijuana club in the Bay Area -- the 6th Street Club formerly run by Ken Hayes -- and they have arrested reporter/writer Ed Rosenthal. The DEA came to Ed's home at 6:30 this morning and Ed greeted them in the nude -- I know the DEA got what they deserved.

Interesting timing for this raid -- the day of the most firm terrorist threat warning since 9/11; the day Asa Hutchison is in the Bay Area for a speech tonight; and the day of the release of the National Drug Control Strategy.

Federal pot raid has SF prosecutors worried

SAN FRANCISCO - San Francisco prosecutors are expressing concern about a marijuana raid carried out at a cannabis club in the city today by federal drug agents.

San Francisco District Attorney's Office spokesman Fred Gardner said he could supply only a few details, but confirmed that agents from the U.S. Drug Enforcement Administration apparently moved in on a Sixth Street club located between Market and Mission streets early this morning. The agents are also going after an East Bay activist, among other possible enforcement actions today, he said.

In November, San Francisco District Attorney Terence Hallinan held a news conference in support of a Northern California doctor whose offices had been raided by DEA agents and specifically warned federal officials to stay away from a city that has for years supported physician-authorized use of medicinal marijuana.

`Lay off our marijuana clubs,'' Hallinan said at the time.

He said that since the passage of state Proposition 215 five years ago the city's system -- in which seriously ill patients whose doctors feel they can benefit from marijuana to reduce pain or increase appetite receive official identification cards -- is working.

`The police live happily with our law,'' he concluded to cheers from the throngs of medicinal marijuana supporters on the steps of the Hall of Justice.

But federal officials may take a different view of the situation. In May, the U.S. Supreme Court ruled in the case of the Oakland Cannabis Buyers' Cooperative that federal anti-drug laws do not permit an exception for these types of marijuana uses.

SAN FRANCISCO, Feb. 12 - On a day when the nation's law enforcement agencies are on the highest alert since September 11, federal agents are busting medical marijuana providers in Northern California. Gina Palencar, national coordinator for Americans for Medical Rights, which has championed seven state laws allowing the medical use of marijuana, said, "This is an obnoxious misuse of federal law enforcement resources. It is bizarre to have teams of federal agents busting medical marijuana suppliers when the nation is on high alert for new terrorist attacks. Today's events prove that the DEA is out of control and badly out of touch with the needs and concerns of Californians and all Americans." DEA agents this morning continued their campaign to shut down medical marijuana providers by raiding the Sixth Street Harm Reduction Center in San Francisco, which provided medical marijuana and assistance to patients who needed to grow their own marijuana, as permitted under state law. DEA agents had no help from local law enforcement agencies. The raids coincide with DEA Administrator Asa Hutchinson's visit to San Francisco to address the Commonwealth Club today, and today's release, in Washington, of the Bush administration's new drug strategy. Palencar said, "In a time of war, we should not be attacking our own wounded. But a brazen Asa Hutchinson has chosen to rub his anti-medical-marijuana agenda in the faces of Californians while he visits our state."

"The Bush administration is depriving patients of medicine and pushing a political agenda that conflicts with the views of most Americans," Palencar said. "It is an awful spectacle to see our leaders turn on the people at a time when we should all be coming together."

Once before Americans were forced to confront and fight the tyranny of their government. That government was in England and was headed by a soon to be mad King George.

Following the single most disputed election in United States history, a new King George was placed on his putative throne in Washington. Surrounding this new tyrant are his despised and distrusted lieutenants. The new Royal Court includes failed politician John Ashcroft as Attorney General, recalcitrant and truculent drug warrior John Waters as Drug Czar, and fellow religious fundamentalist Asa Hutchinson as Chief of the DEA.

This American Taliban led by King (or is it Mullah?) George Bush oppresses the American people in much the same insensitive and unjust fashion as the mad King George of England. Just as the American colonies found their independence and freedoms under assault from England, today Americas sovereign States are under assault from the Washington zealots attempting to run the show on strictly Intra State affairs such as Oregon's Death with Dignity Act and California's pioneering Medical Cannabis program.

The new King is no better than the old one. Instead of hiding behind royal robes, our King George hides behind the "war on terror". It is now clear that the cowardly assault on Americans by real terrorists is being used as the sole rationale for the American Taliban to relentlessly pursue an internal religious crusade that targets the sickest and most vulnerable in our communities. The hastily passed "Patriot Act" is now being applied to the personal affairs of Americans that have nothing whatsoever to do with terrorism. The 4th amendment along with a host of others have been suspended in the name of national security.

Does Congress have the guts to call this King on our expanding tyranny or will our Representatives try to duck out of the fight? Will States Attorney Generals join with Oregon in seeking injunctive relief from Federal overreaching or just measure the polls for the next election? Will voters so fear real terrorists that they will hesitate to throw these new royal rascals out of power?

Today, harm reduction centers and compassion clubs in the Bay Area were raided and shuttered while the Kings lackey Asa Hutchinson came to the City to lay down the law according to the new Washington. The tarnished knights of the DEA had already closed the Los Angeles CRC placing over 900 patients at eminent risk. Just last fall extremists of the Christian right had raided a real Christian, Dr. Mollie Fry, and violated the privacy of thousands of patients. Federal prosecutors doing the new Kings bidding have already convened star-chamber like secret Grand Juries to provide a thin "legal" cover for their assault on States Rights and the sick and dying. What "tea" is about to be thrown into the San Francisco harbor?

It is now past time for our State and Congressional Representatives to act forcefully to protect the Constitutional Rights of the citizenry. It also time to hold all elected officials immediately accountable for just where they stand on liberty.
