Ganjawar News: Dependent Judiciary
Attorney General John Ashcroft just can't leave well enough alone. Here's a guy who, while trampling on our Constitution with the USA Patriot Act, takes time out to go after medical marijuana users.
Well, he's done it again: this time, issuing a memo to U.S. attorneys across the land to report back to him personally whenever a federal judge imposes a sentence that is less than the one called for by the guidelines of the U.S. Sentencing Commission. And he vowed to clog the courts by appealing more of these sentences in the future. Ashcroft was responding to the so-called Feeney Amendment, which Congress passed in April. That amendment warns federal judges that they'll be challenged if their sentences are too low, and they'll even be reported to Congress. Lest you think, though, that Ashcroft was merely responding to a law Congress demanded, think again: Ashcroft's Justice Department actually "championed and wrote the legislation," according to Laurie P. Cohen and Gary Fields of The Wall Street Journal, who broke this story on August 6. "Many judges have voiced dissatisfaction with guidelines they view as onerous, particularly those that establish mandatory minimums for drug sales and possession," wrote Cohen and Fields. "The guidelines are widely credited with the four-fold increase in the federal prison population since 1987." The Feeney Amendment drew fire not only from liberals but from one of the staunchest conservatives in the land: no less than Chief Justice William Rehnquist. Rehnquist said the Feeney Amendment will "seriously impair the ability of courts to impose just and responsible sentences," according to the Journal. But Ashcroft isn't interest in letting the courts decide what is "just and responsible." He wants all that power in his own little hands. And any judge who dares to challenge him will be called on the carpet. This mocks the whole idea of an independent judiciary, one that can decide each case on its merits. i am so glad i don't live in the usa. i have been tokin' for several years here in canada and i have never had a problem. If cops find my bud, they just confisgate it. in fact, here in ontario pot is legalized because of a recent precedent set in the ontario superiour court.

It's not my taste to be homosexual, but I do live in a country where I would think, based on what our founding principles are, we would say to gay people or people who want to smoke marijuana, It's not my taste, but we live in America. It's your taste. Have at it. ................. MAHER: Well, let me give them a platform. Here would be my Democratic platform. Repeal the tax cut for rich people, right? KING: I think they're saying that already, aren't they, most of them? MAHER: OK. End the drug war. You're not going to get serious about the war on terror until you end the drug war. And also, it's a -- it should be a Democratic constituency. People who are suffering from this war, and there are millions, not just people who are in jail who shouldn't be in jail, but police who are corrupted by having to fight this, courts that are clogged -- hemp, if we had hemp available in this country, which is not even marijuana, we wouldn't have to cut down another tree. OK, get Israeli (ph) about fighting the war on terror here at home. And get real about the environment and end corporate welfare. There's a platform. If someone would come out with something like that, I would get behind them. I'd vote Democratic. ................. MAHER: Not me. Canada is, in many ways, like the United States without the b.s... KING: Yes. MAHER: I think Canada -- how sad is that that the place this country is where Canada is hipper than we are now but it's true. If you look at where Canada and I would say Europe also is going where it's heading, you look at the statistics in Europe, in many European countries, less than half the people get married now. They have families and children, they just don't believe in this outdated institution. Marijuana, legal in a lot of these countries. Gay marriage, legal. People don't go to church anymore. 90 percent of France says they're Catholic. 10 percent go to church. That's where the world is moving. But this country? Is moving in the other direction.
