Would a temp agency drug test an employee getting workmans comp?
I ask this because a fellow stoner i work with has a brother who didn't get drug tested at the same workplace and he got injured on the job from an actual accident. My claim would be for aggravated back pain. I have some quick fix coming in the mail, but i still worry a little bit.

Be kind and rewind...write a complaint to your State OSHA office. They don't give much priority to terminated employees, but if you can show that your employer knew you were injured and that your firing was because they thought or knew that you were going to file a claim, then they've committed an act of retaliation and that is something that you can be compensated for as well as punitive or exemplary damages. At the very least it'll give'em liquid shits and a good start on some stomach cancer what with the ass ache that even a casual visit from OSHA can cause. Reticence is for pussies...get a pound of flesh just 'cuz ya can. Might teach 'em a lesson before they fuck with the next member of the proletariat.
The answer to your original question would be - typically yes. If the injury required any sort of medical attention beyond first aid, or if there was property damage involved, most Workers' Comp carriers require it as part of a rate discount that they offer to employers who test. If the person was on Temp Agency policy then it's the policy requirements and restrictions of the Agency. In my State the rules on testing are all bullshit and even without a written policy they get away with firing people that they single out for no good fucking reason. I had a claim and they took hair samples, urine and blood. The nurse told me that if I had showed up with a bald head then she would have snipped some pubes. Just fuckin' with her I asked what would happen if I'd done a body waxing and she said they'd take eye brows, ear hair, whatever they could get their little claws on. What kind'a fucked up Big Brother shit state are we living in?
