Under their pretenses, they were acting legally. If they're going to prosecute, prosecute those that illegally rewrote the law. Not the men and women doing their job, whom would be fully accountable if the laws weren't rewritten for these tactics.

I agree on prosecuting those responsible for giving the orders. Still, any scumbucket carrying out those orders hardly deserves acolades for just "doing their jobs". Torturing is a war crime.

legally, wouldnt holder/prosecution have to go after the lawyers who did rewrite this in the first place? i dont think they could pick and choose, right? if they go after one, then they have to go after all, from lawyers to cheney and bush imo.
edit: after re-reading komps article post on this, it seems to me obama is taking the clinton approach on gays in the military with the dont ask, dont tell policy. in trying to please everybody, he will unfortunately please nobody, and then it will be an even bigger mess down the road. he needs to either go all the way, or nothing.
