'Corporate personhood' referendum passes by wide margin
A Boulder measure that counters the idea that corporations and unions have the same First Amendment rights as individuals -- a concept referred to as "corporate personhood" -- scored an easy win Tuesday night. Question 2H, which pushes for an amendment to the U.S. Constitution that would guarantee that only people are entitled to constitutional rights, won the vote by a nearly 3-to-1 margin. According to the final 12:55 a.m. tally, 18,392 voted in favor and 6,556 voted against.

Last night, Boulder, Colo., became the second city in the nation to pass a ballot measure calling for an amendment to the US Constitution that would state that corporations are not people and the legal status of money as free speech. At midnight, with 93% of the ballots counted, the measure was handily winning with 74% of voters in support. Earlier this year voters in Madison and Dane County, Wisconsin overwhelmingly approved similar measures calling for an end to corporate personhood and the legal status of money as speech by 84% and 78% respectively. Next week voters in Missoula, Montana will have an opportunity to vote on a similar initiative in their community.

The ballot proposal put forward by Councilman Macon Cowles would put Boulder voters on record as favoring an amendment to the U.S. Constitution to “abolish corporate personhood and prohibit the granting of constitutional rights to any entity other than a human being. The proposal also calls for the amendment to “clarify that the expenditure of money is not constitutionally protected free speech so that money spent to influence elections can be subject to reasonable regulation to promote equal protection under the law for all human citizens.”

The concept of corporate personhood goes far beyond the Citizens United ruling. “Corporate personhood” is one of the defining characteristics of the corporation, and it is tightly bound up with a second defining characteristic of the corporation — “limited liability.”

On January 21, 2010, with its ruling in Citizens United v. Federal Election Commission, the Supreme Court ruled that corporations are persons, entitled by the U.S. Constitution to buy elections and run our government. Human beings are people; corporations are legal fictions.

We, the People of the United States of America, reject the U.S. Supreme Court's ruling in Citizens United, and move to amend our Constitution to:

* Firmly establish that money is not speech, and that human beings, not corporations, are persons entitled to constitutional rights.

* Guarantee the right to vote and to participate, and to have our vote and participation count.

* Protect local communities, their economies, and democracies against illegitimate "preemption" actions by global, national, and state governments.


The Supreme Court is misguided in principle, and wrong on the law. In a democracy, the people rule. We Move to Amend.

of the Dodd-Frank Wall Street Reform and Consumer Protection Act (“Dodd-Frank Act”) which
contains certain prohibitions and restrictions on the ability of a banking entity and nonbank
financial company supervised by the Board to engage in proprietary trading and have certain
interests in, or relationships with, a hedge fund or private equity fund.

DATES: Comments should be received on or before January 13, 2012.
ADDRESSES: Interested parties are encouraged to submit written comments jointly to all of
the Agencies. Commenters are encouraged to use the title “Restrictions on Proprietary Trading
and Certain Interests in, and Relationships with, Hedge Funds and Private Equity Funds” to
facilitate the organization and distribution of comments among the Agencies. Commenters are
also encouraged to identify the number of the specific question for comment to which they are
responding.
